Go For It, including its subsidiaries and affiliated operating companies (collectively, “GFI,” “Company,” “we,” “us,” and “our”), respects the privacy of individuals who interact with us. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and protect information when you visit our website, https://www.goforitusa.com, or use any other website, application, product, or online service that we operate and that links to this Policy (collectively, the “Services”). This Policy applies to information we collect through the Services, including online contact, inquiry, interest, membership, club, network, community, or similar sign-up forms, newsletter or marketing sign-ups, our online store, cookies, analytics tools, and other electronic communications between you and the Services, and to information we or our staff create or generate about you in the course of operating our programs.

This Policy does not apply to information collected offline or through other channels unless we expressly state that this Policy applies. It also does not apply to third-party websites, platforms, services, or applications that are not operated by GFI, including our class-management platforms, which are governed by their own privacy policies as described below. We may provide additional or different privacy notices that are specific to certain features, services, or activities.

By using the Services, you acknowledge that you have read this Privacy Policy. If you do not agree with our privacy practices as described in this Privacy Policy, you may choose not to use the Services.

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Throughout this Policy, we refer to the term “Personal Information.” “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. Depending on the law that applies, similar terms such as “personal data” or “personally identifiable information” may be used. Personal Information does not include publicly available information, deidentified information, or aggregated information that cannot reasonably be used to identify a particular individual.

Children’s and Minors’ Data

Our Services are directed to parents, guardians, and gym administrators — not to children. We do not knowingly collect Personal Information directly from a child under the age of 13. Where our Services collect information about a child, such as a child’s name, age, or program interest, that information is provided to us by the child’s parent or guardian, generally in connection with a class inquiry or registration request. If we learn that a child has directly provided us with Personal Information without the involvement of a parent or guardian, we will take steps to delete that information.

Information We Collect or Process

When you use or access the Services, we may collect Personal Information directly from you, such as the following:

• Account and contact information, including your name, mailing address, email address, phone number, and other contact information you provide.
• Information you submit through our online forms, including contact, inquiry, interest, membership, club, network, community, or similar sign-up forms and the contents of any message or inquiry you submit. If you are asking about a program for your child, this may include your child’s age and the program you are interested in.
• Payment and order information. Purchases made through our online store are processed by Stripe. We do not collect or store your full payment card number — Stripe collects your card details directly. In connection with an order, we receive your name, address, phone number, and the items you ordered, which we use to prepare your order, and we maintain your order history.
• Marketing and communications preferences, such as whether you sign up to receive our newsletter, marketing emails, promotional text messages, or other communications from us.
• Content and information you elect to provide as part of any profile, review, chat, email, or other communication you send to us.
• Photographs of athletes that we display on our Services.
• Competition, event, and meet-result information — such as athlete name, score, placement, team affiliation, event participation, and similar competition-related information — that we compile, receive, or obtain from competition organizers, governing bodies, publicly available sources, or other authorized sources and display on our Services.

Health, injury, allergy, and other registration-related information submitted through class-management platforms is addressed in the Class Enrollment Through Class-Management Software section below.

We also may collect certain information automatically when you use the Services, including information about the device, browser, and network that you use. We do not ourselves store your IP address or device information; instead, device markers such as screen resolution, language, operating system and version, browser type and version, and device model are passed, as part of standard web requests, to the service providers we use. This automatically collected information may include:

• Internet Protocol (IP) address;
• Browser type and version;
• Device information;
• Operating system;
• Pages visited and interactions with the Services, including clickstream data, page response times, length of visits, and page-interaction information such as scrolling, clicks, and mouse-overs;
• Referral source, including the page or advertising campaign that brought you to our Services;
• Date and time of visit; and
• General geographic location derived from IP address or similar technical data.

We may collect this information through cookies, pixels, web beacons, log files, and other similar technologies. We use this information to operate, secure, maintain, improve, analyze, and optimize the Services and our business operations. We may also derive non-personal statistical or aggregated data from Personal Information; for example, we may aggregate Personal Information to calculate the percentage of users accessing a specific feature. If we combine or connect non-personal, statistical, or technical data with Personal Information so that it directly or indirectly identifies an individual, we treat the combined information as Personal Information. The specific technologies we use may change from time to time as our business and Services evolve.

Video Surveillance

For the safety and security of our athletes, members, and staff, our gyms use digital video cameras that record and store footage on their own proprietary systems. This footage is used for safety, security, and incident-response purposes. In the course of normal operations, we may also create injury or incident reports, which may include information that we are required to share with law enforcement, healthcare providers, or athlete-safety governing and safeguarding bodies as described in Disclosure of Your Personal Information below.

Cookies and Tracking Technologies

Cookies are small text files stored on a device when a user visits a website, and pixels (sometimes called web beacons) are small pieces of code that help websites recognize user activity, measure engagement, and support website functionality, analytics, and communications. On our Services, we may use one or more of the following types of cookies or similar technologies:

• Strictly Necessary Cookies: These are used to provide the Services, submit forms, prevent fraudulent activity, improve security, and administer the Services.
• Functional and Preference Cookies: These are used to remember choices you make regarding the Services and to provide enhanced functionality.
• Performance and Analytics Cookies: These are used to collect information about how visitors use the Services, including pages visited, referral sources, and performance.

We do not use targeting or advertising cookies, and we do not run advertising pixels or ad-network tracking of any kind. We are not currently using session-replay technology; if we enable it in the future, we will add a specific disclosure and consent mechanism before doing so.

• H. Sensory data: Photographs of athletes that we display on our Services, and video footage recorded by our gyms’ security cameras for safety and security purposes.
• I. Professional or employment-related information: Current or past job history, employer name, job title, work contact information, professional credentials, or other employment-related information.
• J. Non-public education information: Education records directly related to a student and maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, or disciplinary records.
• K. Sensitive Personal Information: Social Security number, driver’s license number, state identification card number, passport number, account log-in credentials, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, contents of mail, email, or text messages not directed to us, genetic data, biometric information used for identification, health information, and sex life or sexual orientation.
• L. Inferences drawn from other Personal Information: Preferences or characteristics inferred from interactions with the Services, marketing preferences, or analytics information, if applicable.

Website Analytics and Infrastructure

We use analytics, error-monitoring, hosting, content-delivery, and similar infrastructure providers to operate, secure, maintain, analyze, and improve the Services. These providers, such as Google Analytics, may receive standard technical information from your browser or device, such as IP address, browser type, device information, pages visited, referral source, and similar usage or diagnostic information. We do not use this information for targeted advertising, and we do not run advertising pixels or ad-network tracking.

Third-Party Service Providers

We use third-party service providers, vendors, contractors, plugins, and integrations to support the operation, security, functionality, performance, analytics, hosting, content delivery, payment processing, email delivery, and communications features of the Services. These third parties may process information on our behalf or collect information directly from your browser or device to provide their services to us. We require service providers to use Personal Information only as necessary to provide services to us or as otherwise permitted by law. We do not control third-party technologies or their independent privacy practices, and we encourage you to review the applicable third party’s privacy policy where relevant.

Managing and Blocking Cookies

Through browser settings, you can manage or block the use of cookies. To effectively manage cookies through browser settings, you must set your preferences on all browsers and all devices that you use. If you clear your browser cache or cookies, you may need to reset your preferences. Please note that blocking or disabling cookies may prevent or impair functionality and use of the Services. Your Choices

You may choose not to provide the Personal Information we request through the Services. However, not providing information we request may restrict your ability to use certain features of the Services. Some Internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, the Websites and Services do not respond to browser “do-not-track” signals.

If you have consented to receive promotional text messages from us, you may opt out at any time by replying STOP to a text message from us, or by contacting us as described below. Message frequency may vary, and message and data rates may apply.

SMS/Text Message Marketing

If you provide your mobile telephone number and affirmatively consent to receive marketing or promotional text messages from us, you authorize us to send recurring marketing text messages to the mobile number you provided. These messages may be sent using an automatic telephone dialing system or other automated technology and may include information about our programs, events, classes, memberships, offers, promotions, and similar updates. Your consent to receive marketing text messages is not required as a condition of purchasing any products or services from us.

Message frequency may vary. Message and data rates may apply. You may opt out of marketing text messages at any time by replying STOP to any marketing text message from us. You may reply HELP for help or contact us using the information in the Contact Information section below. After you opt out, we may send you a confirmation message and may continue to send non-marketing or transactional messages where permitted by law.

We do not sell or share mobile telephone numbers provided for our text-message marketing program with third parties for their own marketing purposes, and we use those numbers only to provide the text-message program you requested or as otherwise permitted by law.

How and Why We Use Your Information

We may use, disclose, transmit, transfer, store, and otherwise process the information described in the Information We Collect or Process section for various purposes, including to:

• Provide you with the Services and any content, features, information, products, or services we make available through them.
• Fulfill and manage orders, deliveries, payments, and returns placed through our online store.

We use Personal Information for the purposes described in this Policy, for purposes disclosed at or before the time of collection, and for other purposes authorized by applicable law or with your consent where required. Our employees, advisors, contractors, and agents may access Personal Information as necessary to perform their duties and support our business operations, subject to appropriate confidentiality and security obligations.

Class Enrollment Through Class-Management Software

If you enroll your child in classes, camps, or other programs, that enrollment may take place through class-management platforms, such as Jackrabbit Class or iClass Pro. Those platforms may collect registration, emergency-contact, health, injury, allergy, or similar information under their own privacy policies and terms, and their handling of that information is governed by those policies. We do not control those platforms’ privacy or data-handling practices, and we encourage you to review their privacy policies and terms before providing information through them. We may access or use information made available to us through those platforms as necessary to administer programs, communicate with parents or guardians, support athlete safety, and operate our business. If we build first-party enrollment or scheduling tools in the future, we will update this Policy to describe how we handle that data directly.

Social Media Features and Links

The Services may include links to our social media pages or other social media features. If you choose to interact with those features or visit a third-party social media platform through the Services, information may be collected and processed by the applicable platform in accordance with its privacy policy and terms of use. We do not control the privacy or data-handling practices of third-party platforms and encourage you to review their policies before providing information or interacting with their services.

Disclosure of Your Personal Information

We do not sell, rent, or lease Personal Information for monetary compensation, and we do not share Personal Information for cross-context behavioral advertising. We may disclose aggregated information, and information that does not identify any individual, without restriction. We may disclose Personal Information as described below:

• To our subsidiaries, affiliates, and operating companies for business and operational purposes.
• To third-party service providers, vendors, and contractors who help us operate, secure, host, analyze, and improve the Services, process orders and inquiries, and provide business, technology, or support services, each bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

• To investigate or prevent unlawful activity, security incidents, fraud, or misuse of the Services, or to protect the rights, property, safety, and security of GFI, our athletes, members, customers, employees, vendors, and others.
• To comply with mandatory reporting obligations under applicable law, including reporting suspected child abuse or neglect to law enforcement or child protective services, and to athlete-safety governing and safeguarding bodies such as the U.S. Center for SafeSport and USA Gymnastics, as required by their policies.
• To fulfill the purpose for which you provide the information, for any other purpose disclosed by us when you provide it, or with your consent.

Sensitive Personal Information

We do not intentionally collect sensitive Personal Information directly through our Services. Where a parent or guardian provides a child’s health, allergy, medical, or similar information through our class-management platforms, or where we process such information in an injury or incident report, we use and disclose that information only for purposes reasonably necessary to provide and administer our programs, support athlete safety, comply with applicable legal or reporting obligations, or as otherwise permitted by law. We do not use sensitive Personal Information for the purpose of inferring characteristics about an individual.

California Shine the Light Law

Pursuant to California Civil Code Section 1798.83, California residents may request and obtain from us, once per calendar year, free of charge, information about the Personal Information we shared, if any, with third parties for their direct marketing purposes in the preceding calendar year. We do not share Personal Information with third parties for their own direct marketing purposes. If you would like to make such a request, please use the contact information in the Contact Information section below and include the subject line “CA Shine the Light.”

Data Transfers and Non-U.S. Users

GFI is based in the United States, and the Services are operated from the United States. If you access the Services or provide information to us from outside the United States, including from Canada, your Personal Information may be transferred to, stored in, or processed in the United States and other jurisdictions where we or our service providers operate. These jurisdictions may have privacy and data-protection laws that differ from those in your jurisdiction. Where required by applicable law, we will use appropriate safeguards for cross-border transfers of Personal Information. By using the Services or providing information to us, you acknowledge that your information may be transferred to and processed in the United States as described in this Policy.

California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), gives you additional rights regarding your Personal Information. This section supplements the rest of this Policy and applies only to California residents. The categories of Personal Information we collect, the categories of sources, the business and commercial purposes for which we collect and use it, and the categories of third parties to whom we disclose it are described in the Information We Collect or Process, How and Why We Use Your Information, and Disclosure of Your Personal Information sections above.

Sensitive Personal Information. Our practices regarding sensitive Personal Information are described in the Sensitive Personal Information section above. We do not use sensitive Personal Information for the purpose of inferring characteristics about you.

Your California rights. Subject to certain exceptions, you have the right to know and access the Personal Information we have collected about you; to delete your Personal Information; to correct inaccurate Personal Information; to opt out of the “sale” or “sharing” of your Personal Information; to limit the use and disclosure of sensitive Personal Information where applicable; and not to receive discriminatory treatment for exercising your rights. We do not sell your Personal Information for monetary consideration, and we do not share it for cross-context behavioral advertising.

How to exercise your rights. You may submit a request using the contact information in the Contact Information section, and you may use an authorized agent to submit a request on your behalf where permitted by law. We will verify your identity and respond within the time required by the CCPA.

Nevada Privacy Rights

Nevada provides its residents with a limited right to opt out of certain sales of personal information. We do not currently sell data in a manner that triggers that statute’s opt-out requirement. Residents who wish to exercise their sale opt-out rights may submit a request to privacy@goforitusa.com.

Security and Retention

We use commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. We also rely on the security practices of our infrastructure, payment-processing, analytics, error-monitoring, hosting, content-delivery, and content-management service providers, which process information on our behalf. Unfortunately, no website, application, system, electronic storage, or online service can be guaranteed to be completely secure. Thus, we cannot guarantee the security of any information you transmit to us, and any transmission is at your own risk.

We keep Personal Information for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law, including for tax, accounting, legal, compliance, dispute-resolution, or business-record purposes. At the end of the applicable retention period, Personal Information will be deleted, destroyed, or deidentified.

The Services may include links to other websites, applications, information, and services provided by third parties, including our class-management platforms and embedded video providers. We are not responsible for the privacy policies or practices of those third parties. We encourage you to review the applicable privacy policies of third parties if you elect to follow links provided through the Services.

Changes to This Privacy Policy

We may update this Policy to reflect changes in our privacy practices, and we will provide notice of any such changes as required by law. When we do so, we will update the “Last Updated” date above. Your continued use of the Services after we make changes is deemed to be acceptance of those changes.
